  • Notify us immediately of any unauthorized access or suspicious activity in your account

You are responsible for all activities that occur under your account, and Cosmo Payment will not be liable for any losses resulting from unauthorized use of your account.

Services Provided

Cosmo Payment offers payment processing services, including but not limited to:

  • Cross-border payments to freelancers, agencies, and other remote contractors
  • Cryptocurrency payouts (such as Bitcoin, Ethereum, etc.)
  • Currency conversion for international transactions

Please note: By using our Services, you acknowledge the inherent risks associated with cryptocurrency transactions, including but not limited to price volatility, potential loss of funds, and regulatory uncertainty.

Fees and Charges

Our Services may be subject to transaction fees, conversion rates, and other service charges. The specific fees applicable to your transactions will be displayed before you complete any transaction.

By using our Services, you consent to the deduction of such fees from the payout or funds transferred through our platform.

Acceptable Use of Services

You agree to use our Site and Services for lawful purposes only and in compliance with these Terms and all applicable laws and regulations. You may not:

  • Use the Site or Services for any fraudulent, illegal, or unauthorized purpose, including money laundering, tax evasion, or circumventing sanctions
  • Use the Services to violate intellectual property rights or proprietary information of others
  • Interfere with or disrupt the operation of the Site or Services
  • Use our Site to engage in abusive, harmful, or offensive conduct, including phishing or other malicious activities

As part of our commitment to ensuring compliance with Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations, Cosmo Payment may require you to provide certain identification documents or verify your account information.

By using our Services, you agree to provide the necessary information and documentation requested to verify your identity. Failure to provide this information may result in the suspension or termination of your account and access to our Services.

Cosmo Payment complies with international regulatory requirements, including those imposed by U.S. authorities, and local regulations in LATAM countries, including Brazil’s Lei Geral de Proteção de Dados Pessoais (LGPD).

Cross-Border Data Transfers

As part of our operations, your personal data may be processed, stored, or transferred to servers located outside your home jurisdiction, including the United States and other countries where our service providers operate. By using our Services, you consent to such transfers.

Cryptocurrency Transactions

When using our cryptocurrency services, you acknowledge that:

  • Cryptocurrency transactions are irreversible and final once processed
  • Cosmo Payment is not responsible for any errors you make in entering wallet addresses or other transaction details
  • The value of cryptocurrencies can fluctuate significantly, and Cosmo Payment is not liable for any loss of value in cryptocurrency transactions
  • Cosmo Payment doesn’t assume processing fees to send cryptocurrency over the blockchain. Prices fluctuate and the user is responsible for these costs.
  • Cryptocurrency transactions may be subject to delays due to blockchain network conditions, and Cosmo Payment is not responsible for such delays

Currency Conversion

When making cross-border payments, the currency conversion rates provided by Cosmo Payment will be displayed at the time of the transaction. These rates are based on real-time market conditions and may include a conversion fee.

Cosmo Payment is not responsible for any losses incurred due to fluctuations in exchange rates after the conversion is completed.

Third-Party Services

Cosmo Payment may integrate with or link to third-party service providers, such as cryptocurrency exchanges, payment processors, and banking partners. When using these third-party services, you acknowledge and agree to the following:

  • The terms and conditions of the third-party services will apply in addition to these Terms.
  • Cosmo Payment is not responsible for the actions or omissions of any third-party service providers, including delays, errors, or breaches of their terms.

User Content

You may have the opportunity to submit content to the Cosmo Payment platform, including feedback, reviews, or comments. By submitting any content, you grant Cosmo Payment a worldwide, non-exclusive, royalty-free license to use, distribute, display, and create derivative works based on your content.

You are solely responsible for the content you submit and must ensure it does not violate the rights of any third parties or applicable laws.

Referral and Affiliate Programs

Cosmo Payment does not currently offer any referral programs or affiliate rewards. If this changes, updated terms regarding any such program will be provided on our website.

Fraud Prevention and Monitoring

Cosmo Payment takes fraud prevention seriously and employs both automated and manual methods to monitor and detect potentially fraudulent or suspicious transactions.

By using our Services, you agree that Cosmo Payment may, at its discretion, temporarily or permanently suspend your account or transaction if we detect unusual activity or suspect fraudulent behavior. We may also report suspicious activity to regulatory authorities in compliance with applicable laws.

Tax Responsibilities

You acknowledge that you are solely responsible for determining, collecting, reporting, and remitting any applicable taxes arising from your use of the Services, including but not limited to income tax, value-added tax (VAT), or other transaction-related taxes, in your respective jurisdiction.

Cosmo Payment does not provide tax advice and will not be responsible for determining any tax liabilities or reporting requirements related to your use of our Services. We may, however, provide you with transaction reports to assist you with your tax filing obligations.

Refunds and Reversals

Due to the nature of cryptocurrency transactions and cross-border financial transfers, all transactions processed through Cosmo Payment are final and cannot be reversed once completed.

However, if a transaction was made in error or you suspect fraud, please contact us immediately. While we cannot guarantee the recovery of funds, we will take reasonable steps to assist in investigating the issue and, where applicable, work with relevant financial institutions or blockchain networks.

Intellectual Property

All content, features, functionality, and intellectual property rights on the Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, software, and designs, are the property of Cosmo Payment or its licensors.

You may not reproduce, distribute, modify, display, or perform any of Cosmo Payment’s intellectual property without prior written consent, except as explicitly permitted under these Terms. Any unauthorized use of our intellectual property may result in legal action.

Force Majeure

Cosmo Payment will not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, epidemics, government regulations, internet service provider failures, or other unforeseeable events.

In the event of a force majeure occurrence, Cosmo Payment will take reasonable steps to minimize disruptions to its Services, but certain delays or interruptions may be unavoidable.

Electronic Communications

By using our Services, you consent to receiving electronic communications from us, including but not limited to notifications, service updates, legal notices, and other important information related to your account. These communications may be sent via email, Telegram, Skype, Whatsapp, SMS, or in-platform notifications.

You agree that all agreements, notices, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You may manage your email or other communication preferences at any time.

User Responsibilities

As a user of our Services, you are responsible for ensuring that your account information is accurate and up-to-date. You agree to notify Cosmo Payment immediately of any changes to your account details or if you suspect that your account has been compromised.

You are solely responsible for any losses or damages resulting from your failure to maintain the security of your login credentials or from inaccurate information provided during transactions.

Termination of Service

Cosmo Payment reserves the right to suspend or terminate your account and access to the Services at our discretion, without prior notice, for any reason, including but not limited to:

  • Violating these Terms
  • Engaging in unlawful or prohibited activities
  • Unqualified engagement of services
  • Failing to provide required AML/KYC documentation

You may terminate your account at any time by contacting our support team. However, termination of your account does not relieve you of any obligations related to transactions or legal liabilities incurred before termination.

Limitation of Liability

To the maximum extent permitted by law, Cosmo Payment, its affiliates, directors, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits
  • Loss of data or information
  • Errors or delays in processing transactions
  • Any damages arising from your use or inability to use the Services

Our liability for any direct damages resulting from the use of our Services will be limited to the fees paid by you to Cosmo Payment in the three months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold Cosmo Payment, its affiliates, and employees harmless from any claims, damages, losses, liabilities, or expenses arising from:

  • Your violation of these Terms
  • Your use of the Services
  • Your violation of any third-party rights or applicable laws

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

Arbitration

For users outside of the United States, any disputes or claims relating to these Terms will be resolved by binding arbitration, conducted in accordance with the rules of the American Arbitration Association (AAA).

Changes to the Terms and Conditions

We may update these Terms from time to time to reflect changes in our business, services, or legal obligations. We will notify you of any material changes by posting an updated version of the Terms on our website and indicating the effective date of the updates.
